FULL NAME OF FORM: Application For Certificate Discharging Liens Securing Fiduciary Performance

WHEN TO USE THE FORM: One year after the filing of the Informal Closing of Estate by Verified Statement, the appointment of the Personal Representative terminates. After the appointment has terminated, the Personal Representative or the sureties may file this verified statement to receive a certificate from the Registrar to obtain the discharge of the Personal Representative. Nebraska Probate Code § 30-24,121.

The purpose of the application is to release security given by the Personal Representative or the surety. It does not affect the liability of the Personal Representative, since the liability of the Personal Representative is controlled by the passage of time alone.

HOW TO USE THE FORM: The signed application should be presented to the Registrar for approval anytime after one year from the filing of the Informal Closing of Estate by Verified Statement. A copy of the signed certificate should be forwarded to the bonding company.

WHEN NOT TO USE THE FORM: This form should not be used when a formal closing is desired pursuant to Nebraska Probate Code §§ 30-24,115 or 30-24,116 or when there is no property given to secure the obligations of the Personal Representative.
