FULL NAME OF FORM: Petition To Allow Personal Representative To Select Homestead Allowance And Exempt Property

WHEN TO USE THE FORM: This form should be used whenever the spouse or children entitled to select homestead allowance and exempt property have not done so, and the Personal Representative desires to make such selection and distribution of the items selected.

HOW TO USE THE FORM: The form should be completed by filling in the number of days which it is desired to allow the individuals entitled to make a selection to make their selection.

WHEN NOT TO USE THE FORM: If spouse or children have made selection of homestead allowance and exempt property.

COMMENTS: Under the statutory provisions no hearing is required nor any notice of the filing or proceeding. See Form 362.
