FULL NAME OF FORM: Certificate Of County Court Proceeding Involving Real Estate

WHEN TO USE THE FORM: The real estate certificate form required by Neb. Rev. Stat. § 25-2708 must be used in any proceeding (formal or informal) in the County Court involving:

  1. The probate of Wills.
  2. The administration of estates.
  3. The determination of heirs.
  4. The determination of inheritance tax.
  5. Guardianships.
  6. Conservatorships.

This form is particularly helpful to title examiners when a proceeding takes place in one county and real estate is located in a second county and should be used where real estate is any part of the assets of the estate or the proceeding.

HOW TO USE THE FORM: The form should be completed and furnished to the Court for signature and then filed with the Register of Deeds of the county in which the real estate is located within ten (10) days after the description of the real estate is filed in the proceeding.

WHEN NOT TO USE THE FORM: The form will generally only be used upon filing of the Inventory, upon determination of inheritance tax, and upon initiation of a proceeding affecting title to real estate. In some instances it may be advisable to use the form when a petition for court action which will affect title to real estate is filed.
