FULL NAME OF FORM: Petition For Supervised Administration When Testacy And/Or Appointment Of Personal Representative Not Previously Adjudicated
WHEN TO USE THIS FORM: This form is used to obtain supervised administration and a determination of the testacy of the Decedent and the priority and qualifications of the Personal Representative. It should be used when the testacy of the Decedent and/or the priority and qualification of the Personal Representative have not been previously adjudicated. Notice and hearing requirements applicable to a formal testacy proceeding must be satisfied.
HOW TO USE THIS FORM: The petition is executed by an "interested person" as defined in Nebraska Probate Code § 30-2209(21) or by an informally appointed Personal Representative.
Paragraph 1 should state the relationship to the Decedent (i.e., heir, devisee, relative, informally appointed Personal Representative) or the nature of the interest in the estate (i.e., creditor, beneficiary).
In paragraph w3, cross out the inappropriate phrase.
In paragraphs 6, 8, and 11, check the appropriate box.
In paragraph 9, in addition, state whether adult, minor or unknown; if minor state date of birth and legal Guardian or Conservator, if any; if incapacitated or under any disability, so state and state name of Conservator or Guardian.
WHEN NOT TO USE THIS FORM: This form should not be used if the testacy of the Decedent and the priority and qualification of the Personal Representative have been previously adjudicated. This form must be filed prior to the distribution of the assets.
