Notice Of Hearing On Allowance Of Claim: NSBA Probate Commentary

WHEN TO USE THE FORM: The Personal Representative is required to serve notice upon commencement of formal proceedings for allowance of a claim; and the claimant is required to serve notice upon commencement, not later than sixty (60) days after notice of disallowance of claim, of formal proceedings for allowance of the disallowed claim.

HOW TO USE THE FORM: Use as printed.

  1. Secure date and time for hearing in County Court at least fourteen (14) days after anticipated service of copies of notice by mail.
  2. Mail notice to the incumbent Personal Representative, if a claimant is the Petitioner, to the claimant, if the Personal Representative is the Petitioner, and to all other persons as the court may direct.
  3. Prepare and file with County Court affidavit of service of notice not later than ten (10) days after service of notice.

WHEN NOT TO USE THE FORM: Do not use unless formal allowance is sought for a claim not denied or for a claim partly or wholly disallowed.
