Demand for Notice: NSBA Probate Commentary

WHEN TO USE THE FORM: This form will be used by the Court when Letters are issued to a Personal Representative. In some counties, the Court utilizes its own form.

HOW TO USE THE FORM: Fill in appropriate dates and names and tender to the Judge (formal appointment) or Registrar (informal appointment). The form may be used for any Personal Representative.

WHEN NOT TO USE THE FORM: Conservators should use Form 746, Guardians should use Forms 710 and 711, Trustees should use Form 600, and Special Administrators should use Form 244.

COMMENTS: Administration of an estate commences with issuance of Letters, and the duties and powers of the Personal Representative commence with appointment. Nebraska Probate Code §§ 30-2403 and 30-2462.

NOTE: Although Letters are not restricted, County Court Rule 37 prohibits payment of a claim of a Personal Representative which arose before death and is in excess of an aggregate amount of $250 without obtaining approval of the Court.
