WHEN TO USE THE FORM: The Personal Representative is required to sign and file the acceptance with the appointing Court, together with any required bond prior to receiving Letters. See Nebraska Probate Code § 30-2444. If the acceptance and any required bond is not filed within sixty (60) days of appointment, the appointment may be set aside. Court Rule 46. The form would be necessary in both formal and informal appointment proceedings as well as in special administration proceedings. HOW TO USE THE FORM: See above. The typed or printed name, address and telephone number of the Personal Representative should be added to the form in the space provided. Notice of the filing should be sent to those demanding notice of this filing. This form may be used by a Special Administrator, defined as a Personal Representative under Nebraska Probate Code § 30-2209(33). WHEN NOT TO USE THE FORM:w When there is to be no appointment of a Personal Representative.
