Order Appointing Special Administrator: NSBA Probate Commentary

FULL NAME OF FORM: Order Appointing Special Administrator In Formal Proceedings

WHEN TO USE THIS FORM: This form is used in conjunction with and responsive to Form 240.

HOW TO USE THIS FORM: Unless the appointment is for a limited and special purpose, the usual reason for appointment in paragraph 4 is because "it is necessary to preserve the estate pending the appointment of a general Personal Representative."

If the appointment is for limited and special purposes, paragraph 4 should state the reasons for the appointment. In such case, paragraph B should be changed to relieve the Special Administrator of the general duty to "collect and manage the assets of the estate", and in lieu thereof, state the limited purpose of the appointment.

If bond is required, use Form 302. Note: Nebraska Probate Code § 30-2209(33) defines "Personal Representative" to include "Special Administrator," ("General Personal Representative" excludes "Special Administrator.")
