Order Setting Date for Hearing and Notice: NSBA Probate Commentary

WHEN TO USE THE FORM: This form may be used with any Application or Petition to be followed by a hearing including but not limited to:

  • formal opening
  • Petition for Supervised Administration
  • Formal Petition for Special Administrator
  • formal closing
  • Determination of Inheritance Tax

HOW TO USE THE FORM: This form is appropriate at any time the Court is required to fix a time for hearing a Petition. This will include all hearings in which publication of notice is mandatory. Proof of the notice referred to in this form must be filed before the hearing in the proceeding. See Form 109 and Notes and Instructions for Form 109. Often a copy of the Order setting the Date for Hearing and for Notice is sent to all interested parties although other forms of notice would be sufficient provided they give the required notice information (i.e. time, date, location etc.).

WHEN NOT TO USE THE FORM: If the Petition for Relief does not require a hearing date to be published or other notice to be given of the hearing. The Court may specify a different manner and time of giving notice. See Forms 107 and 108.
